1. Definition:
Layout of semiconductor integrated circuit (hereinafter referred to as LSIC) is the spatial structure of circuit elements and their interconnections in semiconductor integrated circuits.
2. Protection conditions
A layout-design shall be protected when it satisfies the following conditions:
i) Being original;
ii) Being commercially novel.
3. Who has the right to register
i) Authors create layout designs with their own effort and expense;
ii) Organizations and individuals that invest funds and material facilities for the author in the form of job assignment or hiring, unless otherwise agreed by the parties.
iii) Individuals / organizations have the right to register layout designs from the transfer of registration rights of other individuals / organizations in the form of written contracts, inheritance or inheritance according to the provisions of law.
4. Objects are not protected as LSIC
i) Principles, processes, systems, methods implemented by semiconductor integrated circuits;
ii) Information and software contained in semiconductor integrated circuits.
5. Term of protection
Layout design registration certificates for semiconductor integrated circuits are valid from the following date of issue:
a) Ten years from the date of filing the application;
b) Ten years from the date the layout design is registered by the person having the right to register or the person permitted for commercial exploitation by that person for the first time anywhere in the world;
c) Fifteen years from the date of layout design creation.
